Terms & Conditions Even | Toxic Flow Labs Pte Ltd | geteven.xyz | info@geteven.xyz Terms and Conditions Effective Date: 12 June 2026 These Terms and Conditions (the "Terms") govern access to and use of the Even mobile application, website located at geteven.xyz, related software, interfaces, notifications, communications, content, features and services (collectively, the "Service") provided by Toxic Flow Labs Pte Ltd, a company incorporated in Singapore ("Toxic Flow Labs", "we", "us" or "our"). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not access or use the Service. These Terms include important risk disclosures, eligibility requirements, disclaimers, limitations of liability, indemnities and dispute provisions. You should read them carefully. Nature of the Service. Even is a software interface and mobile frontend that helps users discover, view, track, receive notifications about and access third-party prediction markets, market data, account-related information, wallet-related information and related third-party services, including services made available through Polymarket and other third-party websites, applications, APIs, protocols, smart contracts, data providers, wallet providers, blockchain networks and infrastructure providers. We are not a broker, exchange, clearing house, market operator, investment adviser, financial adviser, bookmaker, casino, gambling operator, payment institution, custodian, trustee, fiduciary, bank or asset manager. Unless expressly stated in writing by us, we do not create, operate, list, administer, custody, settle, resolve, underwrite, guarantee or make markets; do not execute transactions on your behalf as an agent; do not take possession of your funds or assets; do not guarantee prices, fills, market resolution, liquidity, uptime, returns, winnings, rewards or outcomes; and do not provide financial, investment, trading, legal, tax, accounting, gambling, regulatory or other professional advice. Any transaction, position, wallet action, market participation, token transfer, bridge, on-ramp, off-ramp, smart contract interaction, order, trade or claim is between you and the relevant third-party service, protocol, wallet, blockchain, counterparty or market infrastructure. Eligibility. You may use the Service only if you are at least 18 years old or the age of majority in your jurisdiction, whichever is higher, have legal capacity to agree to these Terms, are not prohibited from using the Service under applicable law, sanctions, app-store rules or third-party provider rules, and are not located in or ordinarily resident in a jurisdiction where access to the Service or any relevant third-party prediction market, wallet, token, transaction, promotion or feature is illegal, restricted or requires authorisation that has not been obtained. You are solely responsible for determining whether your use of the Service and any third-party market or transaction is legal in your jurisdiction. If any country, region, person, market, asset, product, promotion or feature is blocked, restricted, prohibited or subject to legal, regulatory, sanctions, provider, app-store or internal compliance limits, you must not access it and we may restrict, suspend, terminate, geo-block, disable or limit access without liability. You must not use VPNs, proxies, false information, device manipulation or other methods to evade restrictions, eligibility checks, sanctions controls, geo-blocking or provider limitations. Account, Wallets and Security. The Service may use Privy or similar third-party wallet, authentication or account infrastructure. Wallets are provided by third parties and may be non-custodial, embedded, smart-contract based, externally owned, user-controlled or otherwise structured according to third-party terms. We do not hold user funds, do not custody user assets, do not control private keys, seed phrases or recovery methods, and do not guarantee wallet access, recovery, security, transaction success or asset availability. You are solely responsible for securing your device, account, wallet, passkeys, passwords, recovery methods and credentials; reviewing all transactions and permissions before approving them; ensuring wallet addresses and networks are correct; maintaining backups where applicable; and understanding all fees, gas, slippage, smart contract risks and blockchain consequences. Blockchain transactions may be irreversible. We are not liable for lost keys, lost devices, compromised credentials, phishing, malware, social engineering, wallet provider errors, incorrect addresses, wrong networks, user mistakes, failed transactions, delayed confirmations, smart contract failures, market failures, chain reorganisations, network congestion, forks or any loss of funds or assets. Risk Disclosure. Prediction markets, crypto assets, blockchain transactions and event-based markets involve substantial risk. You may lose some or all of the value you commit. Market prices can be volatile, illiquid, inaccurate, manipulated, delayed or unavailable. Outcomes may be ambiguous, disputed, delayed, resolved in ways you disagree with, or affected by third-party rules. Markets may be cancelled, paused, changed, delisted, challenged or settled by third parties. Laws and regulations may change quickly and may affect access, legality, taxes, market availability, liquidity, rewards, settlement or your ability to use the Service. Information displayed in the Service may be incomplete, delayed, wrong, stale, mispriced, mistranslated, incorrectly indexed, unavailable or based on third-party sources. Notifications may be delayed, fail to arrive, arrive at the wrong time, contain errors or not be suitable for trading decisions. You are solely responsible for your decisions, transactions, positions, losses, taxes, compliance, and use of any information. You should not use funds you cannot afford to lose. Nothing in the Service is a recommendation, solicitation, offer, inducement, guarantee, promise of profit, investment advice, financial promotion or professional advice. Third-Party Services. The Service may display, deep-link, route, embed, call, integrate with or rely on third-party services, including Polymarket, market data providers, wallet providers, analytics providers, blockchain infrastructure, bridges, oracles, smart contracts, APIs, news sources, sports data sources, app stores, on-ramp or off-ramp providers and other applications. We do not control and are not responsible for third-party services, terms, privacy practices, security, availability, legality, accuracy, fees, market rules, market creation, market resolution, smart contracts, tokens, claims, settlement, execution, liquidity, custody, data, APIs, outages, rate limits or user support. Your use of third-party services is at your own risk and subject to their terms. We may change, suspend or discontinue integrations at any time. User Conduct. You must not use the Service for unlawful, fraudulent, abusive, manipulative, harmful or restricted activity; violate applicable law, sanctions, market rules, app-store rules, provider rules or third-party terms; infringe intellectual property or privacy rights; interfere with security or operation of the Service; reverse engineer, scrape, crawl, overload, attack or exploit the Service except as permitted by law; submit false, misleading or harmful information; use bots, automation or multiple accounts to abuse rewards, referrals, markets, promotions or notifications; evade restrictions; manipulate markets; engage in wash trading, spoofing, fraud, collusion or other abusive conduct; upload malware; or use the Service in a way that could expose us, users, providers or third parties to legal, regulatory, security or reputational risk. We may monitor, investigate, restrict, suspend or terminate access and cooperate with third parties or authorities where we believe activity violates these Terms or creates risk. Notifications, Alerts and Data. The Service may send push notifications, emails, in-app messages and other communications relating to prices, markets, events, lineups, news, movements, positions, PnL, watchlists, new markets, order or trade-related activity, nudges, rewards, promotions, security and product updates. Notifications are provided for convenience only and may be delayed, inaccurate, duplicated, missing or unavailable. They are not advice and should not be relied on for trading or financial decisions. You are responsible for configuring device permissions and alert settings. Rewards, Credits and Promotions. We may offer credits, rewards, referrals, campaigns, reimbursements, incentives or promotional benefits at our sole discretion. Such programmes may be subject to separate terms, eligibility requirements, identity or abuse checks, jurisdiction restrictions, caps, expiry, availability, funding limits, third-party restrictions and verification. We may modify, suspend, deny, claw back, reverse, expire, withhold or terminate any reward or promotion at any time to the maximum extent permitted by law, including where we suspect error, abuse, fraud, ineligibility, manipulation, violation of these Terms, regulatory risk or operational issues. Rewards and promotions do not create a deposit, custody relationship, entitlement, wage, security, investment product or guaranteed payment. Intellectual Property and Licence. The Service, including software, design, logos, names, trademarks, content, data presentation, features and documentation, is owned by us or our licensors and is protected by applicable laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Service for personal, lawful use. We reserve all rights not expressly granted. You may not copy, modify, distribute, sell, lease, sublicense, create derivative works from, reverse engineer or exploit the Service except as allowed by law or expressly authorised by us. You grant us a worldwide, royalty-free, sublicensable licence to use feedback, suggestions or ideas you provide without restriction or compensation. Availability, Changes and Termination. We may modify, suspend, restrict, discontinue or terminate all or part of the Service, any feature, integration, market display, notification, reward, campaign, supported jurisdiction, provider, data source or user access at any time, with or without notice, to the maximum extent permitted by law. We may do so for security, legal, regulatory, sanctions, app-store, operational, business, third-party provider, abuse-prevention or risk reasons. We are not liable for any unavailability, delay, data loss, missed opportunity, missed trade, failed notification, failure to display information, inability to access a market or wallet, or discontinuation of the Service. Privacy. Our collection and use of information is described in our Privacy Policy. By using the Service, you acknowledge that we may collect, process and share information as described there, including with analytics providers such as PostHog and wallet or authentication providers such as Privy, and that public blockchain activity may be transparent and permanent. Taxes and Compliance. You are solely responsible for determining, reporting and paying any taxes, duties, levies or reporting obligations arising from your use of the Service, third-party markets, rewards, promotions, transactions, gains, losses, assets or positions. We do not provide tax advice and may not provide tax forms unless required by law. Disclaimers. To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, error-free operation, uninterrupted operation, compatibility, suitability, profitability, legality in your jurisdiction, or that any market, wallet, transaction, notification, data, reward or third-party service will function as expected. We do not warrant that defects will be corrected, that information is current or correct, that the Service will meet your requirements, or that third-party services will remain available. Limitation of Liability. To the maximum extent permitted by law, Toxic Flow Labs Pte Ltd and its affiliates, directors, officers, employees, contractors, agents, shareholders, licensors, service providers and partners will not be liable for any indirect, incidental, special, consequential, exemplary, punitive or similar damages, or for any loss of profits, revenue, business, goodwill, data, opportunity, use, assets, tokens, funds, market positions, rewards or expected savings, whether based on contract, tort, negligence, strict liability, statute or any other theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service or these Terms will not exceed the greater of SGD 100 or the amount you paid directly to us for use of the Service in the three months before the claim. The limitations apply to all claims, including those arising from third-party services, wallets, blockchains, markets, data, notifications, rewards, unauthorised access, security incidents, legal restrictions, regulatory changes, outages, user error or loss of funds. Indemnity. You agree to indemnify, defend and hold harmless Toxic Flow Labs Pte Ltd and its affiliates, directors, officers, employees, contractors, agents, shareholders, licensors, service providers and partners from and against any claims, demands, actions, losses, liabilities, damages, penalties, fines, costs and expenses, including reasonable legal fees, arising out of or relating to your use of the Service, your transactions, positions, wallet activity, market activity, rewards activity, violation of these Terms, violation of law, violation of third-party rights or terms, evasion of restrictions, fraud, misconduct, negligence, tax obligations or any dispute between you and a third party. App Stores. If you download the Service through Apple App Store, Google Play or another app store, you also agree to that store's terms. The app store provider is not responsible for the Service, content, support, claims, losses or third-party disputes, except as required by applicable app-store terms. We, not the app store provider, are responsible for addressing support requests relating to the Service, subject to these Terms. Governing Law and Disputes. These Terms and any dispute, claim or controversy arising out of or relating to the Service or these Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. Subject to any mandatory rights you may have under applicable consumer law, the courts of Singapore will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, and you submit to the personal jurisdiction of those courts. We may seek injunctive or equitable relief in any competent court to protect our rights, users, systems, confidential information, intellectual property or security. Changes to Terms. We may update these Terms from time to time. Updated Terms will be posted in the Service or on geteven.xyz and will be effective when posted unless otherwise stated. Your continued use of the Service after updated Terms become effective means you accept them. If you do not agree, you must stop using the Service. Miscellaneous. These Terms, together with any policies or additional terms referenced in them, constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, corporate transaction or by operation of law.
